2. Definitions

In these Terms, the following words and expressions have the meanings set out below:
  • "Platform" means the Loppa website and associated services at www.loppa.market.
  • "User" means any individual accessing or using the Platform, whether or not they have registered an Account.
  • "Account" means a registered user profile created on the Platform via Google Sign-In, Apple Sign-In, or email registration, through which the user can access features including applying to attend Events and managing their profile.
  • "Host" means a User who creates and publishes a Listing on the Platform for a pop-up sale Event.
  • "Guest" means a User who applies to attend a Listing and, once accepted, attends an Event.
  • "Listing" means a pop-up sale event posted on the Platform by a Host, including all associated details such as description, images, location, and timing.
  • "Event" means a physical pop-up sale held at the Host's premises, as described in a Listing.
  • "Application" means a Guest's formal request, submitted through the Platform, to attend a specific Event hosted by a Host.
  • "Accepted Guest" means a Guest whose Application has been approved by the Host, granting them access to the Event address and permission to attend.
  • "Third-Party Sign-In" means authentication services provided by third-party platforms, specifically Google Sign-In and Apple Sign-In, which allow Users to create and access their Loppa Account using existing credentials from those providers.
  • "Loppa Merchandise" means physical goods sold directly by Loppa, including tote bags and price stickers, available for purchase through the Platform or associated channels.
  • "Content" means any text, images, descriptions, links, or other material submitted, uploaded, or published by a User on the Platform.

3. About Loppa

Loppa is an online platform designed to connect local communities through the circular economy of secondhand fashion, interiors, and home goods. The Platform enables individuals and small collectives ("Hosts") to create and promote physical pop-up sales, and allows interested shoppers ("Guests") to discover and attend these Events within their local area. Our goal is to make selling pre-loved goods simpler, more social, and community-driven. Loppa brings together people who value sustainability, creativity, and reuse; helping reduce waste and extend the lifespan of quality items. Loppa operates as a digital facilitator and discovery tool. We provide the technology and visibility that help Hosts reach potential Guests, but we do not act as a party to any sale or transaction that takes place at Events. All exchanges of goods and any associated payments occur directly between the individuals involved. Users can browse upcoming pop-up sales and view Event details without registering. To apply to attend an Event, send messages, or manage a profile, Users must create an Account. Accounts can be created using third-party sign-in, or email registration. In addition to facilitating Events, Loppa sells a small range of physical merchandise including tote bags and price stickers to support the community and promote the platform. Loppa is developing a future feature called Loppa Spaces, which will allow Users to book or offer dedicated spaces for pop-up sales. This feature is not yet live. Users who wish to register early interest may sign up to the Loppa Spaces waitlist by providing their first name, last name, email address, product categories of interest, and city and country of residence. This data is collected solely for the purpose of notifying waitlist registrants when Loppa Spaces launches, and is processed on the basis of your consent. You may withdraw your consent and request removal from the waitlist at any time by contacting us at hello@loppa.market. For full details of how this data is handled, please see our Privacy Policy.

4. Eligibility

Use of Loppa is open to individuals who can lawfully enter into binding agreements under the laws of England and Wales. By accessing or using the Platform, you confirm that:
  1. You are at least 18 years of age and have the legal capacity to enter into contracts.
  2. You are accessing the Platform for lawful purposes and in compliance with all applicable local laws and regulations.
  3. You will use Loppa only for personal purposes related to hosting or attending legitimate secondhand pop-up sales, or for purchasing Loppa Merchandise.
  4. You will provide accurate, current, and complete information when registering, listing, or communicating through the Platform.
Loppa's services are primarily intended for users located in the United Kingdom. Access from outside the UK is permitted; however, users are solely responsible for ensuring that their use of the Platform complies with the laws of their respective jurisdictions. We reserve the right, at our sole discretion, to decline, suspend, or terminate access to any user if we believe they do not meet the above eligibility requirements or have otherwise breached these Terms.

5. Account Creation and Sign-In

To access certain features of the Platform — including applying to attend Events, submitting a profile, and communicating with Hosts — you must create an Account. Accounts can be created using approved third-party sign-in providers, or a valid email address. By creating an Account, you agree to the following:
  1. Data collected at registration. Loppa collects your first name, last name, email address, country and city of residence, bio, a profile photograph, optional social media link, and an optional personal description. We do not store passwords or authentication credentials. Where you use a Third-Party Sign-In method, your authentication is handled entirely by that provider subject to their own terms and privacy policy.
  2. Third-Party Sign-In. If you choose to sign in via Google or Apple, you authorise Loppa to receive and store the profile information passed by that provider (typically your name and email address). Your use of Google Sign-In and Apple Sign-In is also subject to Google's and Apple's respective terms of service and privacy policies.
  3. Profile content. You are responsible for ensuring that your profile photograph and personal description are accurate, appropriate, and do not infringe the rights of any third party. Loppa reserves the right to remove any profile content that breaches these Terms.
  4. Account security. You are responsible for maintaining the security of your Account. You must notify Loppa immediately at hello@loppa.market if you suspect any unauthorised access or use of your Account.
  5. One account per person. Each individual may hold only one active Account. Creating duplicate or fraudulent Accounts may result in suspension or termination of all associated Accounts.

6. Use of the Platform

When using Loppa, you agree to do so in a lawful, respectful, and responsible manner. The Platform is intended to help people host and discover local pop-up sales of secondhand items, and to foster a positive community built on trust and sustainability.

Permitted Use

You may use Loppa to:
  • Create and publish legitimate Listings for secondhand pop-up Events;
  • Browse and apply to attend Events hosted by others;
  • Communicate with Hosts or Guests in relation to an Event; and
  • Purchase Loppa Merchandise.

Prohibited Use

You agree not to:
  • Post false, misleading, defamatory, or deceptive information;
  • Use Loppa to advertise new retail items, illegal goods, or prohibited content;
  • Engage in spam, phishing, or unsolicited marketing;
  • Interfere with the operation or security of the Platform, including by attempting to hack, overload, or disrupt its systems;
  • Infringe upon the intellectual property or privacy rights of others; or
  • Use the Platform to arrange Events that could endanger public safety or breach local laws.
Loppa reserves the right to remove or suspend any Content, Listing, or Account that breaches these rules or that we reasonably believe could harm our users or reputation.

User Conduct

You are solely responsible for your interactions and communications with other Users. Loppa encourages all users to act with courtesy, honesty, and integrity when hosting or attending Events. We do not actively monitor user communications, but we may review activity if a concern or complaint is raised.

7. Host Listings

Loppa allows individuals ("Hosts") to create, promote, and manage Listings for pop-up sales of secondhand fashion, interiors, and home goods. By creating a Listing on the Platform, you agree to the following terms and responsibilities.

Host Responsibilities

  1. Accuracy of Information. You must ensure that all details included in your Listing — such as event description, images, brands available, music, approximate location, dates, and times — are accurate, complete, and not misleading.
  2. Compliance with Laws. You are solely responsible for ensuring your Event complies with all applicable local laws, regulations, and permissions, including but not limited to trading, health and safety, and any local authority requirements.
  3. Safety and Conduct. You are responsible for maintaining a safe environment during your Event and for ensuring respectful conduct toward Guests, neighbours, and any third parties.
  4. Guest List Management. You are responsible for managing your guest list, determining how many Guests to accept, and verifying the identity of Guests upon arrival.
  5. Permitted Goods. Only secondhand or vintage items within Loppa's approved categories (fashion, interiors, and home goods) may be sold. The sale of new retail items, counterfeit goods, restricted items, or illegal substances is strictly prohibited. A non-exhaustive list of restricted items is set out in Schedule 1 to these Terms. Loppa reserves the right to update Schedule 1 from time to time, and it is the Host's responsibility to ensure that all items offered for sale at an Event comply with the most current version as published on the Platform.
  6. Direct Transactions. All sales and payments for goods at Events occur directly between you and your Guests. Loppa does not act as a payment intermediary, agent, or escrow service.

Listing Fees

  • Each Event Listing requires payment of a listing fee that is visible on the platform at check-out, payable before publication.
  • Listing fees are non-refundable once a Listing has been published except in the circumstances outlined in clause 10 below.
  • Loppa reserves the right to revise its fee structure at any time. Any changes will be clearly communicated before taking effect.

Listing Moderation

Loppa may review Listings before or after publication to ensure they comply with our policies. We reserve the right to edit, withhold, or remove any Listing that:
  • breaches these Terms or applicable law;
  • is inaccurate, unsafe, or misleading;
  • contains offensive or inappropriate content; or
  • could harm Loppa's users, reputation, or operations.

Event Cancellations

If you cancel or postpone your Event, you must promptly update your Listing and notify any Accepted Guests. Failure to do so may result in suspension or removal from the Platform.

Insurance

Loppa does not require Hosts to hold public liability insurance in order to create or publish Listings. Certain Events may be subject to local authority licensing or venue requirements that require such cover. Hosts are solely responsible for checking and complying with any such requirements. For small, one-off domestic sales held at a private residence, insurance is optional; however, Hosts remain responsible for the safety of Guests and any claims arising from their Events. Loppa does not provide, arrange, or sell insurance and is not an insurer or insurance intermediary.

Disclaimer

Loppa provides the technology to help promote your Event but does not guarantee attendance, sales volume, or success. You acknowledge that Event performance depends on factors outside Loppa's control.

Host Authority and Property Rights

  1. Warranty. By creating a Listing, each Host warrants and represents to Loppa that: (i) they are the legal owner of the property at which the Event is to be held, or have obtained all necessary consents, approvals, and permissions from the relevant owner, landlord, licensor, management company, or other person with a legal interest in or authority over that property to host the Event at that location; (ii) hosting the Event at that location will not breach any lease, licence, tenancy agreement, restrictive covenant, planning condition, or other legal obligation binding on the Host or the property; (iii) they hold any permits, licences, or consents required by applicable law or local authority in connection with the Event; and (iv) they will promptly notify Loppa and remove or suspend their Listing if any of the above warranties cease to be accurate at any time prior to or during the Event.
  2. Loppa's position. Loppa does not verify, and is not responsible for verifying, whether a Host has the authority or permission to host an Event at any given location. Loppa's acceptance of a Listing does not constitute any representation that the Event is lawful, permitted, or appropriate at the stated location.
  3. Indemnity. Each Host agrees to indemnify, defend, and hold harmless Loppa, its directors, officers, employees, and service providers from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) brought by any landlord, freeholder, licensor, management company, local authority, or other third party arising out of or in connection with the Host's failure to hold or obtain the necessary rights or permissions to host an Event at the relevant property.

Host Property and Third-Party Conduct

  1. Loppa's role. Loppa operates solely as a digital facilitator. We do not vet, screen, supervise, or control the conduct of any Guest, accepted attendee, or any other individual who attends or gains access to an Event. We are not party to any arrangement between a Host and a Guest and we do not assume any duty of care in respect of the conduct of any person attending or purporting to attend an Event.
  2. Third-party conduct at Events. Loppa accepts no responsibility and shall have no liability whatsoever for any loss, damage, theft, destruction, or injury to a Host's property, premises, or personal belongings caused by or arising from: (i) the conduct of any Accepted Guest attending an Event; (ii) the conduct of any uninvited individual who gains access to an Event location, whether as a result of address sharing, misuse of address information by a Guest, or otherwise; or (iii) any other third party present at or in the vicinity of an Event.
  3. Hosts' responsibility. Hosts are solely responsible for: (i) deciding who to accept to their Event and managing access to their property during an Event; (ii) the safety and security of their premises and personal property during and after an Event; and (iii) any loss or damage caused to third parties (including Guests) arising from the condition of their premises or their conduct as a Host.
  4. Address misuse. Loppa cannot guarantee that an Accepted Guest will not share an Event address with a third party in breach of their obligations under these Terms. Loppa shall have no liability for any loss or damage resulting from such unauthorised disclosure or any resulting uninvited attendance at an Event.
  5. Insurance recommendation. Whilst Loppa does not require Hosts to hold public liability insurance or home contents insurance as a condition of using the Platform, we strongly recommend that Hosts check with their existing home, contents, or personal liability insurer whether their policy covers the hosting of pop-up sales events at their property and, if not, consider obtaining appropriate cover. Loppa does not provide, arrange, or sell insurance and is not an insurer or insurance intermediary.
  6. Indemnity. Each Host agrees to indemnify, defend, and hold harmless Loppa, its directors, officers, employees, and service providers from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) brought by a Guest, an uninvited third party, or any other person arising out of or in connection with any Event hosted by that Host, including but not limited to any claim relating to personal injury, property damage, theft, or the conduct of attendees at that Event.
  7. No liability for facilitated access. Loppa shall not be liable to any Host for any loss or damage, whether to property, premises, or otherwise, on the basis that Loppa facilitated the circumstances giving rise to that loss by: (i) enabling the Host to publish an Event Listing and share their Event address with Accepted Guests through the Platform; (ii) operating the application and acceptance mechanism through which Guests are permitted to attend Events; or (iii) providing or displaying any information, content, or functionality through the Platform in connection with an Event. A Host's decision to create a Listing, accept Guests, and host an Event at their premises is made voluntarily and at their sole discretion. Loppa's role in facilitating that process does not make Loppa a cause of, or contributor to, any harm or damage suffered by the Host as a result of the conduct of any Guest or third party at that Event.

8. Guest Registration and Attendance

Loppa enables registered Users ("Guests") to browse Events and submit Applications to attend. By submitting an Application or attending an Event, you agree to the following terms and responsibilities.

Registration and Profile

  1. Account required. To apply to attend an Event, you must have a registered Account. Unregistered users may browse Listings but cannot submit Applications or view Event addresses.
  2. Accurate details. Your Account must contain accurate, current, and complete information, including your name, email address, country and city of residence, profile photograph, and personal description.
  3. Application message. When submitting an Application, you may include a personal message to the Host. You are responsible for ensuring this message is honest, respectful, and relevant.

Host Acceptance

Hosts have sole discretion over who they accept to attend their Events. Loppa does not guarantee that any Application will be accepted. Hosts may accept or decline Applications for any reason that does not constitute unlawful discrimination.

Address Sharing and Confidentiality

To protect the privacy and safety of Hosts, Event addresses are handled as follows:
  1. Access for Accepted Guests only. The full address of an Event will only be visible on the Event page to Users who have been confirmed as Accepted Guests by the Host. Users who have not been accepted will not be able to see the address.
  2. No email distribution. Loppa does not send Event addresses by email. Accepted Guests must log in to the Platform and view the Event page to access the address.
  3. Host consent. By creating a Listing, the Host consents to Loppa displaying their Event address to Accepted Guests on the Event page.
  4. Guest obligations. Accepted Guests must treat the Event address as private and confidential. You must not share, post, or disclose the address to any third party. The address is provided solely for the purpose of attending the specific Event for which you have been accepted.
  5. Misuse of address. Any misuse of an Event address — including sharing it publicly, using it for any purpose other than attending the Event, or attending without acceptance — constitutes a serious breach of these Terms and may result in immediate Account suspension and referral to the relevant authorities.
  6. Loppa's role. Loppa displays address information solely as a technical facilitator. We are not responsible for any incident arising from the misuse of address information by any User.

Conduct and Participation

  • Guests must behave respectfully and safely when attending any Event listed on Loppa.
  • You agree not to engage in conduct that could cause harm, damage, or disruption to the Host, other attendees, or the venue.
  • You are responsible for your own safety and personal belongings during attendance.

Cancellations and Changes

  • If you are unable to attend an Event for which you have been accepted, you are encouraged to notify the Host as soon as possible.
  • Loppa is not responsible for any changes, postponements, or cancellations made by Hosts.
  • Event details are subject to change, and we recommend checking the Listing shortly before attending.

Transactions at Events

All purchases, exchanges, or negotiations for goods occur directly between Guests and Hosts in person. Loppa is not involved in and does not oversee or guarantee any transaction, refund, or item quality at Events.

Assumption of Risk

By attending an Event listed on the Platform, you acknowledge that your participation is voluntary and at your own risk. Loppa accepts no responsibility for any injury, loss, or damage arising from attendance or interaction with Hosts or other Guests.

9. Loppa Merchandise

In addition to its event facilitation services, Loppa sells a range of physical goods ("Loppa Merchandise"), including tote bags and price stickers. The following terms apply to all purchases of Loppa Merchandise.

Ordering and Payment

  • All Merchandise orders are subject to availability. Loppa reserves the right to withdraw or amend product offerings at any time without notice.
  • Prices for Loppa Merchandise are displayed on the Platform and are inclusive of VAT where applicable. Prices may be updated from time to time.
  • Payment for Merchandise is processed securely via approved third-party payment providers. Loppa does not collect or store your full payment card details.
  • An order confirmation will be sent to your registered email address upon successful purchase.

Delivery

  • Loppa Merchandise will be dispatched to the delivery address provided at the time of order. You are responsible for ensuring your delivery details are accurate.
  • Estimated delivery timescales are provided at the point of purchase and are indicative only. Loppa is not liable for delays caused by third-party couriers or circumstances outside our control.
  • Risk of loss or damage to Merchandise passes to you upon delivery.

Returns and Refunds

  • You have the right to cancel your order and return Merchandise within 14 days of receipt, in accordance with the Consumer Contracts Regulations 2013, provided the items are unused and in their original condition.
  • To initiate a return, please contact us at hello@loppa.market.
  • Refunds will be issued to the original payment method within 14 days of Loppa receiving the returned goods.
  • Loppa reserves the right to decline a return where items have been used, damaged by the customer, or returned outside the 14-day window without prior agreement.

Faulty or Incorrect Items

If you receive a faulty or incorrect item, please contact us at hello@loppa.market within 14 days of receipt. We will arrange a replacement or full refund at no additional cost to you. Nothing in this clause 9 affects your statutory rights as a consumer. Where Loppa Merchandise is supplied to a consumer, the goods must be of satisfactory quality, fit for purpose, and as described, in accordance with the Consumer Rights Act 2015. Your statutory rights under the Consumer Rights Act 2015 in respect of faulty, misdescribed, or unsatisfactory goods are not affected or limited by any provision of this clause 9.

10. Fees and Payments

While browsing the Platform is free for all users, certain services are subject to a fee.

Listing Fees

  • Hosts are required to pay a listing fee as noted on the platform before an Event Listing is published on the Platform.
  • All applicable fees are clearly displayed before purchase. Payment is required in full prior to publication.
  • Listing fees are non-refundable once the Listing has been published. Loppa may, in its sole discretion, issue a refund where: (a) a verified technical error on the Platform prevented publication; (b) Loppa removes or cancels the Listing for reasons unrelated to user conduct; or (c) the Listing is rejected prior to publication for reasons outside the Host's control.

Payment Processing

  • All payments made through Loppa are processed securely via approved third-party payment providers.
  • Loppa does not collect or store users' complete payment or card details.
  • By making a payment, you authorise our payment provider to process the transaction in accordance with its own terms and privacy policy.

Future Services

Loppa may introduce additional paid features in the future. Any new fees or material changes will be clearly communicated in advance and will only apply after reasonable notice has been provided to users.

Taxes

All prices displayed on the Platform include VAT where applicable. Users are responsible for any additional taxes or levies arising from their own activities, such as income generated from goods sold at hosted Events.

11. Intellectual Property

Loppa's Intellectual Property

  • All intellectual property rights in and to the Platform, including the Loppa name, logo, domain, layout, design, and underlying code, are owned or lawfully licensed by Loppa.
  • Except as expressly permitted by these Terms, no part of the Platform may be copied, reproduced, distributed, transmitted, modified, or otherwise exploited for commercial purposes without Loppa's prior written consent.
  • You are granted a limited, revocable, non-exclusive licence to access and use the Platform solely for personal and lawful purposes connected with browsing, listing, or attending Events, and purchasing Loppa Merchandise.

User Content and Rights

  • You retain ownership of Content you submit through the Platform.
  • By uploading or publishing any Content, you grant Loppa a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, and promote that Content in connection with operating and marketing the Platform including on Loppa's social media channels.
  • You confirm that you have the necessary rights or permissions to upload such Content and that it does not infringe any third party's intellectual property rights.

Infringement Notices

If you believe any material on the Platform infringes your intellectual property rights, please notify us at hello@loppa.market with a description of the infringing content, proof of ownership, and your contact details. We will investigate and, where appropriate, remove or restrict access to the material.

12. User-Generated Content

By submitting or publishing any Content on the Platform, including Event descriptions, profile photographs, personal descriptions, social links, images, or messages, you agree to the following.

Content Standards

You agree that all Content you post will:
  • Be accurate, lawful, and not misleading;
  • Respect the privacy and intellectual property rights of others;
  • Not contain defamatory, discriminatory, obscene, or otherwise inappropriate material; and
  • Not include advertising or promotional content for goods or services unrelated to your Event.
You are solely responsible for any Content you upload and for any consequences arising from its publication.

Moderation and Removal

Loppa reserves the right, at its sole discretion, to edit, withhold, or remove any Content that breaches these Terms, infringes third-party rights, poses a risk to user safety or privacy, or could harm Loppa's reputation or operations. Loppa does not actively monitor all submissions but may review or remove Content where complaints or potential breaches are identified.

13. Privacy and Data Protection

We are committed to protecting your personal data. Loppa collects and processes the following personal information: your first name, last name, email address, country and city of residence, profile photograph, personal description, and optional social media link. This data is collected at the point of Account registration and may be updated by you at any time through your Account settings. Your use of the Platform is also governed by our Privacy Policy, which provides full details of how we collect, store, use, and share your personal data, your rights under UK GDPR and the Data Protection Act 2018, and how to contact us with data-related requests. Specific information regarding the retention of your data can be found in Section 6 of our Privacy Policy. By creating an Account or using the Platform, you acknowledge that you have read and understood our Privacy Policy.

14. Loppa's Role and Liability

Loppa operates as a digital facilitator connecting people who wish to host or attend local pop-up sales of secondhand goods. We provide the technological platform that enables discovery and promotion of Events but do not participate in, supervise, or guarantee any transaction or interaction that arises from use of the Platform.

Platform Role

  • Loppa acts solely as an information and event-listing service.
  • We do not own, inspect, store, or manage any items offered at Events.
  • We are not a party to any agreements, contracts, or transactions between Hosts and Guests at Events.
  • We do not mediate disputes between users arising from Events.
  • Any sales, exchanges, or communications that occur through or as a result of the Platform are conducted entirely at the users' own discretion and risk.

Disclaimers

While we aim to maintain a reliable and secure Platform, Loppa:
  • Does not guarantee uninterrupted access, error-free functionality, or the accuracy of user-generated information;
  • Makes no representation as to the quality, safety, legality, or authenticity of any goods sold or Events hosted;
  • Is not responsible for cancellations, postponements, or changes made by Hosts; and
  • Is not liable for loss or damage arising from any user's reliance on Content published on the Platform.
All Content and Listings are provided "as is" and "as available". Users are encouraged to exercise judgement, verify details independently, and take reasonable precautions when attending Events or engaging with others.

Limitation of Liability

To the fullest extent permitted by law:
  • Loppa shall not be liable for any indirect, incidental, consequential, or punitive losses, including loss of profit, revenue, goodwill, or data.
  • Loppa's total aggregate liability to any user, whether arising in contract, tort (including negligence), statutory duty, or otherwise, shall not exceed the total amount of fees paid by that user to Loppa in the twelve (12) months preceding the event giving rise to the claim.
  • Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded under the laws of England and Wales.
  • Nothing in these Terms limits or excludes any statutory right you have as a consumer that cannot lawfully be excluded, including your rights under the Consumer Rights Act 2015 in respect of goods (that they be of satisfactory quality, fit for purpose, and as described), digital services (that they be performed with reasonable care and skill), and the fairness of any term that has not been individually negotiated. Your rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and any other applicable consumer protection legislation are similarly unaffected.

User Responsibility

Users acknowledge that participation in Events and interactions with others through the Platform are voluntary and at their own risk. Hosts and Guests are responsible for ensuring their compliance with all applicable health, safety, and legal requirements in connection with their activities.

15. Indemnity

By using the Platform, you agree to indemnify, defend, and hold harmless Loppa, its directors, officers, employees, and service providers from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
  • Your breach of these Terms or any applicable law or regulation;
  • Any Content you post, upload, or share through the Platform;
  • Any Event or activity you host, organise, or attend that is promoted through Loppa;
  • Your misuse of the Platform or of another user's data; or
  • Your infringement of any third-party rights, including intellectual property, privacy, or data-protection rights.
Nothing in this section requires users to compensate Loppa for losses resulting from Loppa's own negligence, fraud, or wilful misconduct, or any liability that cannot lawfully be limited or excluded under the laws of England and Wales.

16. Termination and Suspension

Loppa may, at its discretion, suspend, restrict, or terminate your access to the Platform where necessary to protect users, ensure compliance with law, or maintain the integrity of the service.

Grounds for Termination or Suspension

Your access to Loppa may be suspended or terminated without prior notice if:
  • You breach any provision of these Terms or any applicable law or regulation;
  • You engage in conduct that is fraudulent, abusive, harmful, or likely to damage Loppa's reputation or other users;
  • You misuse the Platform, including posting prohibited Content or hosting non-compliant Events;
  • Required by law, court order, or regulatory authority; or
  • You request that your Account be deleted.
Where feasible, Loppa will provide notice of suspension or termination, explaining the reason and giving an opportunity to respond.

Effect of Termination

  • Upon termination, your right to access or use the Platform will cease immediately.
  • Any Listings, Content, or Event information associated with your Account may be removed or archived at Loppa's discretion.
  • Termination does not affect any rights or obligations that have already accrued to either party before the date of termination, including outstanding payment obligations.

Reinstatement

If you believe your access was suspended or terminated in error, you may contact Loppa at hello@loppa.market to request a review. Loppa may, at its sole discretion, reinstate access where appropriate.

Survival of Provisions

Clauses relating to intellectual property, limitation of liability, indemnity, and governing law will continue to apply even after termination or suspension of access to the Platform.

17. Changes to These Terms

We may update or modify these Terms from time to time to reflect changes in our services, legal requirements, or business practices. Any changes will be posted on this page with a revised "Last Updated" date. Where changes are material, we will endeavour to notify registered users by email or through the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts. Loppa is not currently a member of an approved ADR scheme. We are not obliged to participate in alternative dispute resolution but are required to notify you that disputes may be referred to CDRL. Further information is available at cdrl.org.uk.

Schedule 1 — Restricted Items

The following items may not be sold at any Event hosted through the Platform. This list is non-exhaustive and Loppa reserves the right to determine, in its reasonable discretion, that any item not listed below is nonetheless a restricted item for the purposes of these Terms.
  1. Illegal and Dangerous Items — weapons, controlled drugs, stolen goods, hazardous chemicals, flammable or explosive materials, radioactive substances, and any item that is illegal to sell under UK law.
  2. Unsafe or Non-Compliant Products — items that do not meet applicable UK safety standards or carry required certifications (including the UKCA marking where required), including unsafe electrical goods, uncertified lithium-ion battery products, non-compliant children's toys, and any product subject to an active safety recall.
  3. Counterfeit and Infringing Goods — fake, replica, or counterfeit branded products; items infringing third-party intellectual property rights (including trade mark, copyright, or design rights); unauthorised copies of media or software; and goods misrepresented in terms of origin, authenticity, or provenance.
  4. Age-Restricted Items — alcohol (unless the seller holds a valid personal licence and the relevant premises licence or temporary event notice under the Licensing Act 2003); tobacco and vaping products; adult content or items of a sexually explicit nature; fireworks; and knives, in each case subject to applicable UK age restriction laws and any additional licensing requirements.
  5. Animals and Protected Species — live animals; products derived from endangered or protected species (including ivory and prohibited furs); and any item in violation of CITES or applicable UK wildlife trade regulations, including the Control of Trade in Endangered Species Regulations 2018.
  6. Health and Wellbeing — products making unsubstantiated medical or health claims; unlicensed supplements or remedies; pharmaceuticals or medicinal products (whether prescription or over-the-counter) not lawfully authorised for sale; and any content or item that promotes or facilitates self-harm, hate, or violence.
  7. Food and Drink — any food or drink products that do not comply with the Food Safety Act 1990 and applicable food hygiene regulations; products lacking correct labelling in accordance with The Food Information to Consumers Regulations 2014; and food or drink sold by a Host who is not registered as a food business with the relevant local authority where such registration is required.
  8. Digital and Fraudulent Goods — pirated or unlicensed digital content; fraudulent vouchers, gift cards, or tickets; personal data belonging to third parties; and hacking, surveillance, or interception tools or software.
  9. Items Subject to Export Controls or Sanctions — any item the sale, transfer, or export of which is restricted or prohibited under applicable UK or international sanctions, export control legislation, or trade embargo measures.
Hosts are solely responsible for ensuring that all items offered for sale comply with applicable laws and regulations, including but not limited to the Consumer Protection Act 1987, the Trade Marks Act 1994, the Misuse of Drugs Act 1971, the Licensing Act 2003, and the Food Safety Act 1990.
